Kramer LLP Secures Sweeping Victory for RavenWhite Licensing in Eastern District of Texas Patent Litigation
Kramer LLP, acting as lead counsel for plaintiff RavenWhite Licensing LLC, has secured a decisive string of pretrial wins in patent infringement litigation against Walmart Inc. and Wal-Mart Stores Texas, LLC, pending in the United States District Court for the Eastern District of Texas (Case No. 2:24-cv-00688-JRG-RSP).
On March 30, 2026, District Judge Rodney Gilstrap adopted Magistrate Roy Payne’s recommendation in full, denying Walmart’s arguments that U.S. Patent Nos. 11,562,402 and 10,594,823 are invalid under 35 U.S.C. § 101. One week earlier, the Court issued a comprehensive Claim Construction Order resolving all disputed claim terms across the two asserted patents, rejecting every indefiniteness challenge raised by Walmart and adopting constructions favorable to RavenWhite at each turn.
The asserted patents, which are generally directed to internet browser cookie technology and tiered advertisement bidding systems, survived Walmart’s Alice eligibility challenge at both Steps 1 and 2. The court found that the ‘402 Patent recites a “technological solution” applying machine learning to targeted advertising, and that the ‘823 Patent “specifically creates a new type of cookie that better identifies individual users for website customization and fraud prevention.”
In claim construction, the court rejected Walmart’s indefiniteness arguments on six separate terms, declined to apply 35 U.S.C. § 112(6) to various claim limitations Walmart sought to invalidate as means-plus-function elements lacking corresponding structure. And the Court adopted RavenWhite’s positions on all key terms in dispute.
