Kramer LLP Partner Rob Kramer Secured Important Appeals Win for The University of Michigan in Patent Infringement Case

April 25, 2023

Robert Kramer, who served as lead counsel for The University of Michigan, secured an important and strategic appeals win after the U.S. Court of Appeals for the Federal Circuit unanimously upheld the validity of the university’s valuable and foundational white light laser microscope technology patent. The Federal Circuit’s decision followed an inter partes review that Leica Microsystems filed challenging the validity of the university’s patent, in which the appeals court reaffirmed the patent’s validity in full.

The ruling was a decisive victory for The University of Michigan and a rejection of Leica’s central validity challenge. With the decision, Leica was estopped from re-litigating the validity of the university’s patent, and the infringement case, University of Michigan v. Leica Microsystems, resumes in the U.S. District Court for the Northern District of California to address Leica’s infringement of the university’s patented technology. The result is a past example that underscores Kramer LLP’s primary commitment to protecting the foundational innovations of inventors and research institutions against the world’s largest companies.
