Nicki Glauser
Nicole (“Nicki”) Glauser is a board-certified trial attorney who represents patent owners in high-stakes enforcement matters, with matters involving aggregate claimed damages exceeding one billion dollars. She is trusted by clients and litigation funders to lead complex enforcement strategies from inception through trial, translating complex technologies into compelling presentations for juries and judges.
Nicki serves as lead trial counsel with experience in all phases of litigation in district courts nationwide and in the Federal Circuit. Her trial record includes three patent cases tried to conclusion in major venues, including the Eastern District of Texas, Western District of Texas, and Northern District of California, and three Federal Circuit oral arguments. She has extensive experience working with litigation funding partners on strategic patent enforcement campaigns against Fortune 100 technology companies.
She has represented inventors, universities, and technology companies across a wide range of technologies, including wireless communications, internet platforms, semiconductors, multimedia systems, gaming devices, renewable energy, and biotechnology.
Nicki is consistently recognized among the top lawyers in her field. She was the eighth attorney nationwide and the first Austin-based attorney to earn Board Certification in Patent Litigation by the National Board of Trial Advocacy (NBTA), an honor held by approximately three percent of U.S. lawyers. She has been named a Texas Super Lawyer every year since 2015, and for many years has been named a Texas Top Women Attorney.
After graduating from the University of Texas School of Law, Nicki clerked for the Honorable David M. Ebel on the United States Court of Appeals for the Tenth Circuit, practiced at Vinson & Elkins LLP, and was a partner at DiNovo Price LLP before joining Kramer LLP.
Co-lead trial counsel for ASSIA, founded by a Stanford University professor, in high-stakes patent enforcement action targeting Charter’s Spectrum services implementing patented wireless optimization and profile management technology. Successfully defeated motion to transfer, obtained favorable claim construction, and achieved PTAB clean sweep with denial of all five inter partes review petitions challenging ASSIA’s foundational patents. Co-lead trial counsel representing technology company in patent enforcement action against Apple involving foundational display brightness control technology originally developed by Microsemi and implemented across iPhone and MacBook product lines. Co-lead trial counsel representing IngenioSpec, a pioneer in wearable electronics innovation, in two patent enforcement actions against Apple targeting AirPods, AirPods Pro, and Beats products. Cases assert six patents covering foundational wireless earbud technologies including hearing enhancement systems, wireless communication techniques, and charging infrastructure. Set for trial 2027. Trial counsel in patent litigation against Samsung involving mobile device user interface technology implemented across Galaxy smartphone and tablet product lines. Case asserts three patents covering innovative touch interface designs, virtual keyboards, and edge-based touch event capture systems. Set for trial 2026. Lead counsel in patent enforcement action against major telecommunications carriers involving STIR/SHAKEN caller ID authentication and fraud-prevention technology. Obtained favorable claim construction before achieving successful settlement with all defendants including Verizon, AT&T, and T-Mobile after establishing strong infringement positions. Trial counsel representing Polaris in its patent infringement case against Dell and Microsoft Corp. relating to display screen automatic brightness control technology. Achieved favorable settlement following successful claim construction. Opposing counsel: Covington & Burling and Alston & Bird.
Lead trial counsel for Papst in patent enforcement action against Samsung involving data transfer and USB interface technology. Secured $5.9 million jury verdict for willful patent infringement, with court denying Samsung’s post-trial motions to overturn the verdict following extensive post-trial briefing.
Represented Preservation Technologies in enforcement of patents developed by the University of Southern California relating to architecture and techniques for indexing, accessing, distributing, and surveying multimedia data. Attained favorable settlements against multiple accused infringers, including Netflix, DISH, Facebook, Sony, and Hulu, after securing favorable discovery and pleading-stage rulings. Represented KlausTech in action alleging Google’s infringement of a patent claiming a process for Internet advertising on websites and mobile applications. Case settled favorably after defeating two motions to dismiss and an invalidity challenge during claim construction. Represented a large research university and its exclusive licensee in a patent infringement suit against a Fortune 50 computerized search company. Case settled favorably after jury selection. Opposing counsel: Fish & Richardson and King & Spalding.
